Investigators allege the three men provided alcohol and hashish to the minor and three other girls they encountered in a public garden on the night of March 4, ultimately leading to acts that now carry potential prison sentences under Portugal's criminal code.

According to the PJ's investigative summary, the minor was in unauthorized absence from her care facility when she met the three suspects in a garden within the city center. The men allegedly supplied hashish and alcoholic beverages to the victim and her companions, causing the 13-year-old to lose full control of her faculties.
Investigators say the victim was then transported to one suspect's residence, where "sexual acts of significance were committed by all three men in alternating sequence." The PJ alleges the assaults continued even after the minor partially regained her faculties and refused further contact, and that the suspects were aware throughout that they were engaging with a child aged 13.
The police statement emphasizes that forensic and testimonial evidence collected during the investigation "strongly indicates the denounced crime and its authorship." Prosecutors presented this material to the court, which deemed it sufficient to justify continued detention pending trial.

Pre-trial detention is reserved for the most serious offenses where suspects pose a flight risk or threat to public safety. Under Article 164 of the Portuguese Penal Code, rape preceded by conduct rendering the victim incapable of resistance carries 3 to 10 years imprisonment. When the victim is a minor, the penalty increases by one-third under Article 177, reflecting the aggravated nature of the offense.
