Dutch Trafficking Suspect Arrested in Algarve Under European Arrest Warrant

The Portugal Judiciary Police detained a 70-year-old Dutch national in Vila Real de Santo António last week under a European Arrest Warrant issued by French authorities. The suspect consented to his surrender, and the Court of Appeal of Évora has authorized his transfer to France, where he faces prosecution for drug trafficking offenses.

The Arrest

On a Wednesday in early March, officers from the Portugal Judiciary Police apprehended the Dutchman in Vila Real de Santo António, a border municipality in the district of Faro. The arrest was executed pursuant to a European Arrest Warrant issued by French judicial authorities, according to a statement published by the Attorney General's Office in Évora.

When the suspect was brought before the Évora Court of Appeal on Friday, he waived his right to contest the transfer. Portuguese prosecutors recommended immediate surrender, and the court granted it. He remains in custody pending physical handover to French law enforcement.

Understanding the European Arrest Warrant

The European Arrest Warrant, a streamlined judicial instrument in force since January 2004, replaced cumbersome extradition procedures within the European Union. Under Portuguese law, courts assess warrants for offenses punishable by at least 12 months' imprisonment. For serious crimes including drug trafficking, no dual-criminality check is required.

When a suspect consents to transfer, as in this case, the process moves rapidly. Portuguese law requires that handover occur within 10 days of the final court decision. If a suspect refuses transfer, detention can extend for up to 60 days while the court reviews grounds for refusal—such as double jeopardy or statute of limitations concerns. Legal representation is automatic, and interpreters are provided at state expense.

Why Vila Real de Santo António?

Vila Real de Santo António sits directly across the Guadiana River from Spain, offering proximity to road crossings, the river itself, and Faro International Airport. The municipality's border location has made it a known transit point for trafficking activities. The Portuguese Judiciary Police maintains heightened enforcement activity in the area, alongside customs scrutiny at Faro Airport and visible presence in marinas and border crossings.

What Happens Next

Once transferred, the Dutch suspect will face trial in a French criminal court. If convicted, he could receive a sentence ranging from 5 to 30 years, depending on the quantities involved, his role, and his prior record. France maintains strict penalties for serious drug offenses.

This case illustrates Portugal's role within the European Union's criminal justice framework and its commitment to mutual legal cooperation. The swift authorization by Évora's court demonstrates the efficiency of the European Arrest Warrant system when suspects consent to transfer.
